TERMS AND CONDITIONS OF ISSUE OF BNH MEMBERSHIP ACCOUNT

It is acknowledged that the Membership Account to which this application relates is issued upon the following terms and conditions.

1. Account Responsibility

The BNH Membership Holder is solely responsible for the account and all courts booked on that account in all respects.  An account should not be used by any other person other than the owner.

2. Ownership

Notwithstanding the provisions of Clause 1 above, the account always remains the property of Badminton North Harbour. The Applicant shall at no time gain or retain any right of ownership in respect of the account.

3. Fees

Badminton North Harbour reserves the right to charge such fees as it considers (at its sole discretion) to be fair and reasonable, including (but not limited) to:

a. An annual account service fee will be payable for each account on a twelve month cycle each year. In the event that the service fee is not paid then Badminton North Harbour shall have the right to make the account invalid until such time that the fee is paid.

b. An account fee will be charged at the time of any new account application, and this will be charged each twelve months at the rate of the membership whether the account member is a NH Club member or a membership account holder. A registered club member will pay $20.00 per annum and a BNH membership account holder will pay $60.00 per annum. This fee maybe altered at any time dependant on what BNH approve.

c. A Court hire fee as Badminton North Harbour may from time to time consider appropriate.

4. Account Cancellation

Badminton North Harbour reserves the right to cancel an account and/or its validity for such reasons as it (at its sole discretion) may consider appropriate, including (but not limited) to:

a. If the membership account remains unused for such period as Badminton North Harbour considers indicates that the account holder no longer wishes to utilise the account. In such case, Badminton North Harbour may, at its sole discretion, request the cancellation of the account. (In the case of such recall, payment of any credit balance held to the account shall be made only to the account holder)

b. In the event of any conduct on the part of the account holder which Badminton North Harbour considers (at its sole discretion) to be a misuse of its facilities, or misconduct by the account holder. This includes any third party using the account holder’s account.

5. Miscellaneous

Badminton North Harbour reserves the right to:
a. Amend or change the Membership Account or BNH Booking System
b. Amend or change the Membership Account itself (in which case Badminton North Harbour shall be entitled to require that the membership account be updated to the amendment or changed to what it considers appropriate).
c. Institute such new fees and charges in respect of the account holder as Badminton North Harbour requires.
d. Alter fees and/or charges payable in respect of the account holder and/or the basis for charging of such fees or charges.

6. Communication

Notices of any sort shall be deemed to be properly communicated if emailed or Txt by Badminton North Harbour to the last known information of the account holder. It shall be deemed that the said notice is considered to have been received by the account holder on the second working day after the posting of such notice.

7. Court Booking

a. A BNH Membership account holder may only book courts up to 21 days in advance.
b. Each account may only book one court per hour.
c. If a court is cancelled within 24 hours of playing, the court charge will remain, cancellations made outside the 24hr period will receive a full refund.

I hereby apply for a BNH Membership Account, which I understand is to be used by me and/or my family and is not transferrable to any other person or organisation. I accept the responsibility of owner and user and undertake to respect the property and rules of Badminton North Harbour (Inc.) at all times.

I consent to the above details being used by Badminton North Harbour for the purposes of membership and for it to retain, use and disclose these to Badminton New Zealand and to sponsors.

I acknowledge my right to access and to correct any of this information.
